1. Terms of Service

By accessing or using the Exclusio platform or NFT membership services, you agree to be legally bound by our Terms of Service.

These terms are governed by the Information Technology Act, 2000, and its associated rules, along with any other applicable laws in India.

Users must be at least 18 years of age.

Any misuse of the platform for unlawful, abusive, or fraudulent purposes will lead to immediate termination of access and legal consequences.

We reserve the right to modify or terminate our services, access rights, or membership rules at any time with prior notice.

2. Privacy Policy

We are committed to protecting the privacy and personal information of our members, in accordance with:

Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, under the IT Act

Anticipated regulations under the Digital Personal Data Protection Act, 2023

Key principles include:

Personal data (e.g., name, address, KYC info, financial documents) is collected only with consent.

Data is securely encrypted and never sold or shared without permission.

Members can request access or deletion of their data at any time.

Our global operations also adhere to GDPR standards where applicable for non-Indian residents.

3. Intellectual Property Rights

All content on the Exclusio platform, including logos, designs, brand names, digital experiences, event content, codebase, and NFT artwork, is the exclusive intellectual property of Exclusio Technologies Private Limited.

Unauthorized use, duplication, or resale of IP is strictly prohibited and punishable under the Indian Copyright Act, 1957 and the Trade Marks Act, 1999.

Members purchasing NFTs receive limited license rights to use the NFT as an access token — not ownership of the underlying IP.

In case of any violation, we reserve the right to pursue civil and/or criminal legal action.

4. Refund & Cancellation Policy

As part of our Web3 model:

All NFT sales are final and non-refundable, in line with the decentralized, irreversible nature of blockchain transactions.

Refunds may only be considered in the rare case of platform-related errors or failed minting transactions, subject to internal audit.

Memberships once activated cannot be transferred, canceled, or exchanged unless otherwise approved in writing.

This policy complies with Indian Contract Act, 1872 and relevant e-commerce guidelines.

5. Member Code of Conduct

All members of Exclusio are expected to follow a strict Code of Conduct, aligned with luxury community standards and Indian values.

This includes:

Respectful behavior at events, physical properties, and digital communities

No harassment, abuse, or illegal activity

Maintaining confidentiality regarding other members and Exclusio partnerships

Compliance with Exclusio's event policies, partner rules, and digital use guidelines

Violation of the code may result in immediate suspension or permanent revocation of membership privileges and NFT access.

6. Disclaimer

The information, services, and NFT access provided by Exclusio are:

Subject to market risks, crypto asset volatility, and evolving regulatory frameworks.

Exclusio does not offer investment advice, guarantee asset appreciation, or promise fixed benefits.

Participation in NFT offerings and member privileges is voluntary and made at the sole discretion of the individual.

All services are provided “as-is” and “as available.” Exclusio shall not be liable for any incidental, direct, or indirect loss arising from membership usage or third-party partnerships.
